The U.S. Drug Enforcement Administration (DEA) has proposed banning tianeptine under its authority to schedule substances under the Controlled Substances Act of 1970.

The deadline to act and contest this proposed ban is Friday, August 7. Here is what we are doing about it—and how you can help.

What We’re Doing

Tianeptine Depot organized and brought together a coalition of several other companies in the industry that has committed nearly $100,000 to the Rights & Reason Project (rightsandreasonproject.com) and Students for Sensible Drug Policy (SSDP). Both organizations specialize in challenging prohibitions of exactly this kind, and we expect our coalition’s financial commitment to grow. 

Here is how the process works. Counsel at the Rights & Reasons Project is filing a request for an administrative hearing before the DEA. If the hearing is granted, the same counsel will litigate the matter. That hearing will be our opportunity to present the case directly to the DEA: banning this compound would cause real, demonstrable harm to legitimate scientific research.

Winning that argument requires a plaintiff who embodies that harm. Ours is a research scientist who has studied this compound for more than a decade—not a symbolic plaintiff, but someone whose life’s work, professional standing, and ongoing studies are directly at stake. That is what makes this challenge viable rather than merely academic.

We want to be straightforward about what this is and what it is not.

Challenges like this are close to a coin flip—when someone actually brings them. Most of the time, no one does. The rule takes effect, the industry absorbs it, and the administrative record closes with barely a word raised against it.

We intend to fight this one hard, and we feel good about our chances. Our near-term goal is straightforward: delay the ban from taking effect so that we have time to build the strongest possible case.

The Bigger Picture

Step back from tianeptine for a moment, because what is at stake here is bigger than any single compound. The broader question is whether serious scientific research can still be conducted in the United States at all.

Banning a substance outright does not end the research—it sends it overseas. For example, a prominent scientist conducting human trials on this compound has already moved that work to Germany. That is the pattern: the science does not disappear; it simply happens somewhere else, and the discoveries, funding, and expertise leave with it. The country the rest of the world once came to for this kind of work is quietly becoming the country scientists leave.

It is never the large, well-funded institutions that bear the greatest burden. They can afford the lawyers, licenses, and laboratories abroad. The burden falls on the independent researcher, the small laboratory, and the university group working with a modest grant.

Every time we put a promising compound out of reach, we do not make the country safer. We make it smaller—less capable, less curious, and less willing to allow people to ask difficult questions and pursue the answers.

We will continue funding the research, funding the fight, and keeping you informed about how the effort is progressing.

How You Can Help

The public comment docket closes this Friday, August 7, 2026. First, a word about why public comments matter—and why coordination matters.

The public comment record is the foundation on which our challenge will be built. Objections that are not raised during the comment period may later be treated as forfeited. An argument that no one puts into the record may be one that no decision-maker is ever required to address.

The breadth and specificity of the record are therefore critically important. But sheer volume and repetition accomplish little. A thousand identical letters can be answered in a single sentence, while fifty specific, firsthand accounts may each require an individualized response.

Here is the most important point: please do not file a comment on your own before speaking with our counsel. A comment that conflicts with our legal strategy could actively harm the effort. If your comment would strengthen the record, we want to help you submit it properly and at no cost to you.

2 — If a Ban Would Cause You Concrete, Documented Harm, You May Be a Plaintiff

A viable case requires a particular and demonstrable injury, such as an active research protocol, professional licensure, or a business facing a quantifiable loss.

We are assisting the Rights & Reason Project in identifying individuals and organizations that may have standing to participate as additional plaintiffs. Our role is to connect qualified candidates with the Project’s legal team, and lead counsel will independently evaluate whether their participation would strengthen the case. 

Plaintiffs would not be responsible for any legal fees or litigation costs, but they must be willing to be publicly named in the lawsuit, work with counsel, and participate as reasonably required throughout the case. Plaintiffs will be compensated for the time they devote to that participation.
